We reserve the right to refuse any order you place with us. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may apply to orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. (a) During the Evaluation Stage and Funded Stage, you must not exceed the maximum loss limit, which is based on a percentage of the initial account size. Ensure that the maximum loss does not surpass this limit at any time.
The limits for the Evaluation and Funded Stage are:
(b) During the Evaluation Stage and Funded Stage, you must not exceed the maximum daily loss limit, which is based on a percentage of the starting equity or balance of the day. The higher value between equity and balance will be used for this rule. Ensure that the maximum daily loss does not surpass the daily loss limit on any given day. The daily maximum loss is determined based on the equity or balance at 00:00 CEST/server time and remains in effect until the next 00:00 CEST/server time.
The limits for the Evaluation and Master Stage are:
(c) During the Evaluation Stage, you are required to meet specific simulated profit targets based on the initial account size and the model you are following without breaching any rule stated in the Terms & Conditions. Additionally, you must have at least three minimum profitable trading days.
The targets are as follows:
(d) Customers shall not perform simulated FOREX Trading in violation of: (i) the operation of real financial markets, (ii) the current General Terms and Conditions of XPERT Markets, (iii) the current trading rules of XPERT Markets which are available on XPERT Markets Trading Rules and the Responsible Trading Policy, see Appendix A.
(e) If the customer fails to comply with the conditions specified in sections 7.a, 7.b, 7.c, and 7.d during the Evaluation Stage, the Evaluation will be marked as “not passed.” In such instances, the Customer’s account and Services will be terminated and canceled without any refund of the fees paid.
If the customer does not adhere to the conditions outlined in sections 7.a, 7.b, and 7.c during the Funded Stage, the Funded account will be marked as “not passed.” In such scenarios, the Customer’s account and Services will be terminated and canceled without any refund of the fees paid.
(a) The account must not be inactive for more than 30 calendar days. Inactive means no trades have been executed on the account.
(b) Profit from trades that are closed within 1 minute after opening will not be counted on the Funded account. If any deductions result in a breach of the daily loss limit or maximum loss limit, the Customer is responsible for the violation.
(c) News Trading and holding over the weekend: Trades can be held over the weekend. Profit from trades opened or closed within 8 minutes before and after high-impact news events and/or speeches on the affected currency will not be counted on the Funded account unless the trade was executed 12 hours prior to the news event. This restriction applies to all forms of trade execution, including manual, pending, stop loss, and take profit orders. During news speeches, the prohibited window extends from 8 minutes before to 8 minutes after the speech has ended. News event trading will result in the deduction of any profits made from trades executed within the restricted 16-minute window. Our system may automatically close the affected trades that are opened within the prohibited time window. Forex Factory is used as the news calendar source. If any deductions result in a breach of the daily loss limit or maximum loss limit, the Customer is responsible for the violation.
(d) FORBIDDEN TRADING PRACTICES AND TOXIC GAMBLING BEHAVIOR: The following trading practices and toxic gambling behaviors are prohibited during simulated trading:
2. High Leverage (Over-Leveraging): Participating in trades with disproportionately high levels of risk in relation to the trader’s capital or risk tolerance. This often involves utilizing excessive leverage, causing overexposure or full margin, leading to high potential losses. Additionally, only on the 2-Step Funded account, engaging in excessive amounts of lots relative to the account size exceeding the allowed Lot Exposure Limit.
If you exceed this limit, all profits from trades that were opened above the limit will be deducted. If any deductions result in the breach of the daily loss limit or maximum loss limit, the trader is responsible for the violation.
The first time we detect the lot exposure limit exceeded, it will result in a warning. The second time will result in account closure, profit deduction, and a 30% performance commission, plus all profits from trades above the limit will be deducted.
Copy trading or account management by a third-party vendor is prohibited. Using a third-party Expert Advisor is allowed only if it is a trade or risk manager. Using other third-party Expert Advisors is not allowed.
We may carry out casual risk interviews to ensure there are no prohibited or suspicious activities. Failure to comply with risk verification may result in withholding of remuneration and termination of services.
If suspected of violating trading practices, we may terminate the contract, stop services, or impose restrictions. The Company reserves the right to determine forbidden trading practices and toxic behaviors.
If involved in forbidden trading practices, access to all services may be blocked without compensation or remuneration.
We may provide access to third-party tools, which are provided "as is" without warranties. The use of such tools is at your own risk, and you should review their terms and conditions before use.
Activities aimed at exploiting platform inefficiencies such as gap trading, high-frequency trading, and arbitrage are prohibited. Customers must trade responsibly and adhere to market-standard risk management practices.
We may conduct periodic risk verification, and failure to comply may result in withheld remuneration and termination of services.
Your submission of personal information is governed by our Privacy Policy.
Proprietary trading firm employees and traders using multiple email addresses are strictly prohibited from engaging in trading activities.
We reserve the right to terminate your access for violating any of the prohibited uses.
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Intellimark, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. In no event shall Intellimark be considered a liability of Intellimark. We are not responsible for ensuring the payment of any such commission or remuneration, and any fees or commissions associated with sales are expressly excluded from our liability.
You agree to indemnify, defend, and hold harmless Intellimeter and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
Once you dispute an order payment it has an adverse impact on the company, financially, and causes damage to our company profile in the eyes of the Payment Gateway. Hence, according to our policy, we will be banning accounts (directly involved in the dispute/against the same order number) of traders who dispute their payments and moving forward we will not entertain any requests to unban the account(s). The user who is involved in a disputed transaction in the normal course of the business, where there has not been any problem on our side, such users won’t be eligible for any further accounts with XPERT Markets and all their other active accounts will be closed. This policy is in place to protect XPERT Markets from any financial adversity as well as to ensure the long-term viability of the brand name.
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). All trading activities conducted on your simulated accounts must be legitimate and carried out with common sense, as if they were performed on accounts trading in a real environment. Traders should use our simulated accounts with high integrity and professionalism, adopting prudent risk management strategies as if they were trading their personal accounts with their own funds.
Take care of your accounts and use them as if trading your capital on your account. Prioritize capital preservation when the market environment seems or tends to be much riskier than usual. Implement profit preservation measures and avoid risking excessive profits. Do not risk more than 3% per trader, trade idea, or position. Your biggest losing trade should not exceed 3% of the account size to avoid toxic gambling trading. XPERT Markets offers payouts every 7, 14, or 30 days. There is no reason to engage in reckless and unprofessional trading behavior. Our top traders generate roughly around 5% a month, and we emphasize this approach.
To maintain a high level of proficiency and minimize losses, it is essential to periodically review and assess your trading practices. Involve thoroughly examining your trading activity, including both successful and unsuccessful endeavors.
